Requirements

  • Document proving death of the deceased:
    • The original of the excerpt from the Registry of deaths, which can be obtained at any municipality office in the Republic of Serbia.
  • Documents proving ownership over property that constitutes legacy:
    • This documentation may be an agreement, real estate certificate, court decision or any other document based on which the deceased acquired the right of ownership over such property.
    • It is recommended to submit this documentation along with the motion, although it is not mandatory and notary public or court shall in any case determine which property constitutes legacy.
  • Documents proving heir’s right to inherit
    • The original of the birth certificate and/or marriage certificate, which can be obtained at any municipality office in the Republic of Serbia.
